Term of Service

Introduction

This document sets out the terms and conditions for using the VoiScribe - Speech Recognition iOS Application (“the App”) developed by Openly LLC. By using the App, you are agreeing to these terms. If you do not agree to these terms, do not use the App.

Purpose of the App

The App is a tool for converting spoken words into written text. The App is intended for personal use only, and Openly LLC does not guarantee the accuracy of the text generated by the App.

Limitation of Liability

Openly LLC does not hold any responsibility for any consequences of using the App. You use the App at your own risk and agree to indemnify and hold Openly LLC harmless from any claims, damages, or losses arising from your use of the App.

Intellectual Property

The App, including its code, design, and content, is protected by intellectual property laws and is the property of Openly LLC. You are not allowed to extract the models and use them for your own services. In addition, the use of the data for machine learning or developing systems similar to or the same as the Service is prohibited.

Warranty

Openly LLC provides the App “as is” and does not make any warranties, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. Openly LLC does not guarantee that the App will meet your requirements or that its operation will be uninterrupted or error-free. Openly LLC may discontinue the Service at any time.

Changes to Terms of Servicet

Openly LLC reserves the right to modify these terms at any time and without prior notice. Your continued use of the App after any changes to these terms constitutes your acceptance of the new terms.

Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from or in connection with the Service between you and Openly LLC will be exclusively resolved by the Tokyo District Court as the court of first instance.

In compliance with laws and regulations

In the event that any provision of these Terms is deemed to conflict with consumer contract laws or other laws, such provision shall be invalid only to the extent of such conflict. However, even if such a determination is made, the remaining provisions of these Terms shall remain in effect and shall not be invalidated.

Effective Date

These terms are effective as of February 20th, 2023.

By using VoiScribe - Speech Recognition iOS Application, you acknowledge that you have read and understood these terms and agree to be bound by them.
